DESCRIPTION:
The law is specifically targeted at helping establish “clean-coal” power and syngas plants in the state. The state requires any new “clean coal” power plants to sequester an increasing amount of its carbon dioxide emissions, but also compels Illinois electric retailers to purchase up to 5 percent of their requirements from “clean coal” facilities. Additionally, the law also entitles one “clean coal” facility with a final air permit, to enter into 30-year purchase agreements for sale of its output.

The sequestration requirements are as follows: 50 percent for those plants planning on going into operation before 2016, 70 percent for plants starting in 2016 and 2017, and 90 percent for plants scheduled to start operating after 2017.The act requires coal-fired power plants to incorporate other emissions controls on sulfur dioxide, nitrogen oxides, carbon monoxide, particulates and mercury so that the plant would emit no more of those pollutants than would a similar sized natural gas-fired power plant.
